Rights and agreements related to research data

Research data can be associated with many kinds of rights and the need to agree on their governance, use, and distribution. This page instructs you on how to agree upon the rights of the data you use, produce and share.

According to the legislation, in general, research data created in the course of science cannot be 'owned' in the true sense of the word. The legislation of the European Union emphasizes the freedom of movement and exchange of information and in this connection has tried to dismantle its obstacles. and related lighter related rights only concern research data that exceeds the work threshold (mainly audiovisual data, in some cases texts).of 15 years from their completion, within which the author gets to fully benefit of its content. However, there are many kinds of rights and administrative decision-making power associated with research data.

According to the data policy of the Ä¢¹½Ö±²¥, if the intellectual property rights of the parties who originally created the data or handed it over for research use do not differ, the ownership rights to the research data basically belong to the person/persons who compiled the data. However, ownership of data research data acquired with the university's funds or created in the university's employment relationship belongs to the university.

In research, it is necessary to agree on the authorship of the data, who manages the data and makes decisions about its use and possible publication, and with what rights and ways the data can be used. In this way, conducting the research is secured, risks are managed and the usability of the material is taken care of, also in case of possible personnel changes or conflicting situations. Thus, understanding, identifying and agreeing on data rights are an essential part of data management.

According to the data policy of the Ä¢¹½Ö±²¥, in order to take care of the rights of research data and to enable related agreements, research data compiled by more than one person must be designated an administrator, who is generally the Principle Investigator for the research project.

The research may also use data whose (author's) rights belong to other than researchers, in which case it may be necessary to agree separately with the rights holders on the use of the data.
